1. Who we are

Waku Memory is a service of AutoManus Technologies, Inc. ("AutoManus", "we", "us"). These terms cover waku.one, the Waku Memory console, the API and MCP server at api.waku.one, and the Waku plugins that connect coding agents to it. By using any of them you agree to these terms.

The open-source Waku agent on GitHub runs on your own computer and is covered by its own licence, not by these terms.

2. Waku Memory is an alpha

Features will change, and data can be lost. Keep your own copy of anything you cannot afford to lose.

3. Your account

• You sign in with GitHub, Google or, in the phone app, Apple or an email address. You must be at least 13 years old and able to agree to these terms. The Waku phone app is for people 18 or older.
• Keep your sign-in and your API keys secure. You are responsible for what happens under your account.
• If you use Waku Memory for an organisation, you confirm you are allowed to accept these terms on its behalf.

4. Your content

The memories you store, the sessions you capture and the files you import are yours. You give us permission to store, process and show that content only to run Waku Memory for you and for the people you choose to share it with. We do not sell it, and we do not use it to train AI models.

You are responsible for having the right to store and share what you put into Waku Memory.

5. Capture

Capture is off until you turn it on. When it is on, what you type and what your agent replies are sent to Waku Memory and turned into memories. The Privacy Policy lists exactly what is and is not sent. You can turn capture off at any time.

6. Spaces

Your memories are private until you propose one to a space. Once a proposal is accepted, every member of that space can see it. Owners and admins of a space can see proposals waiting for review.

7. Acceptable use

Do not use Waku Memory to break the law, to store content you have no right to, to access other people's data, or to disrupt or overload the service. Do not resell access to the API without our written permission.

8. Plans and billing

• Waku Memory has a Free plan and a Pro plan. Pro costs $20 per seat per month, billed monthly in advance through Stripe. Prices do not include any taxes that may apply.
• Your invoice names AutoManus Technologies, Inc.; your card statement shows WAKU.
• You can cancel at any time from Manage billing in the console. Your plan returns to Free. A change of plan never deletes anything you stored.
• If a payment fails, Pro stays on for 7 days, then the account returns to Free.
• Payments are non-refundable, except where the law requires otherwise. If a charge looks wrong, write to us and we will look into it.
• We will tell you at least 30 days before a price change affects your bill.

9. Ending your use

You can stop using Waku Memory at any time. To delete your account and its data, write to us from the email address on your account. We may suspend or close an account that breaks these terms, and will tell you why unless the law prevents it.

10. No warranty

Waku Memory is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows.

11. Limitation of liability

To the fullest extent the law allows, AutoManus is not liable for indirect, incidental or consequential losses, or for lost data or profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

12. Changes to these terms

When we change these terms we will update the date above. If a change materially affects you, we will tell you by email or in the console before it takes effect.
